Relocating with your child during or after a divorce or custody ruling isn’t as simple as packing up and moving to a new city. In Florida, the law treats a “petition for relocation” very seriously, because any major move can directly affect your child’s well-being, schooling, and relationship with both parents. If you’re a parent considering relocation or opposing it, it's essential to understand how the process works, what the court considers, and how family law attorneys can help protect your rights and your child’s future.

What Is a Petition for Relocation?

A petition for relocation is a formal request to the court asking for permission to move with your child more than 50 miles away from your current residence for at least 60 consecutive days. This could be for a new job, family support, financial opportunities, or even a fresh start after divorce.

But here’s the catch: in Florida, you can’t simply decide to move if there’s an existing custody order or parenting plan. The parent who wants to relocate must file a petition and notify the other parent. Without consent or a court order, making the move could result in legal penalties and even affect custody rights.

What Does the Court Consider?

The Florida courts place one guiding principle above all else: the best interests of the child. To make this decision, judges will look at:

  • Impact on the Child’s Relationship with Both Parents: Will relocation make it harder for the child to maintain a meaningful relationship with the non-relocating parent?

  • Educational and Emotional Well-Being: Does the move provide better schooling, healthcare, or overall stability?

  • Reasons for Relocation: Is it to improve the family’s financial situation or to gain family support or is it to create distance from the other parent?

  • Feasibility of a New Parenting Plan: Can both parents still maintain strong involvement in the child’s life through visitation, virtual communication, or extended stays?

Every relocation case is unique, but the courts always weigh these and other factors with the child’s best interests as the top priority.

Why Relocation Cases Can Be So Challenging

Relocation disputes often become emotional because both parents truly believe they’re acting in the child’s best interest. One parent may see new opportunities for stability, while the other worries about losing precious time with their child. These cases can quickly escalate into complex legal battles where emotions run high and the outcome can permanently shape a child’s future.

This is where experienced family law attorneys make a difference. Having a knowledgeable attorney ensures that your case is presented clearly, with strong evidence and a strategic plan.
